Terms of Service

Welcome to Bumpie! These Terms of Service ("Terms") govern your use of the Bumpie mobile application ("App") provided by Utopia ("we," "us," or "our"). By downloading, accessing, or using Bumpie, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using our App, you confirm that you are at least 13 years of age and agree to comply with these Terms. If you do not agree, please do not use the App.

2. Description of Service

Bumpie is a food safety companion app designed to help users make informed decisions about food consumption during pregnancy. The App allows you to:

Scan food items to receive safety information
View personalized recommendations based on your pregnancy profile
Track foods you've scanned and reviewed
Access food safety guidelines and information

Important Medical Disclaimer: Bumpie provides general food safety information for educational purposes only. This information is not intended to be, and should not be used as, a substitute for professional medical advice, diagnosis, or treatment. Always consult your healthcare provider with questions about your pregnancy, diet, or health conditions.

3. User Accounts

To use certain features of the App, you must create an account using Apple Sign-In or Google Sign-In. You are responsible for:

Maintaining the security of your account credentials
All activities that occur under your account
Notifying us immediately of any unauthorized access

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscription and Payments

Bumpie offers premium features through paid subscriptions:

Weekly Plan: $3.99 per week
Monthly Plan: $9.99 per month (includes a 7-day free trial)

Subscriptions are billed through Apple's App Store. By subscribing, you agree to:

Payment will be charged to your Apple ID account at confirmation of purchase
Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
You can manage and cancel subscriptions in your App Store account settings
No refunds will be provided for partial subscription periods

Free trial eligibility is determined by Apple and may only be available to new subscribers.

5. User Content

When you use Bumpie, you may upload food images for scanning. By uploading content, you:

Grant us a license to process, store, and analyze the images for providing our services
Confirm you have the right to upload such content
Understand that images are stored on our servers to improve your experience

6. Prohibited Uses

You agree not to:

Use the App for any illegal purpose
Attempt to reverse engineer or copy any part of the App
Upload malicious content or interfere with the App's operation
Share your account credentials with others
Use automated systems to access the App
Misrepresent the App's information as professional medical advice

7. Intellectual Property

The App, including all content, features, and functionality, is owned by Utopia and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

8. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that:

The App will be uninterrupted or error-free
Food safety information will be complete or accurate for your specific situation
The App will meet your specific requirements

9. Limitation of Liability

To the maximum extent permitted by law, Utopia shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim.

Health Decisions: You acknowledge that all health and dietary decisions during pregnancy should be made in consultation with qualified healthcare professionals. Utopia is not liable for any health outcomes resulting from reliance on information provided by the App.

10. Indemnification

You agree to indemnify and hold harmless Utopia from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes through the App or via email. Your continued use of the App after changes constitutes acceptance of the updated Terms.

12. Termination

We may terminate or suspend your access to the App at any time, with or without cause. Upon termination:

Your right to use the App will immediately cease
You may request deletion of your data as described in our Privacy Policy
Provisions that should survive termination will remain in effect

13. Governing Law

These Terms are governed by the laws of the Republic of Korea. Any disputes shall be resolved in the courts of the Republic of Korea.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Utopia regarding the use of Bumpie.
